Default malpractice psychologist

Is it possible to sue an independant contracter hired by a state agency (CPS) wihthout naming the state agency as a co-defendant? I have evidence that the contracter used unethical practice and reports of other medical and non medical mental health professionals that are in direct conflict with his reports.

Yes you often can, and you may and perhaps should file a complaint with his licensing Board as well. They will investigate promptly.
