Confused Black mold found in my apartment... Can I break the lease?

State: Washington

I found black mold in my apartment and I have a 9 month old baby. As far as i know it's a health hazard, but can i break my lease?

‘Black Mold’ can cause serious health risks. Research has been proved that it is closely linked with death of babies from respiratory bleeding and it can cause asthma and bronchitis. Remember it is your right to get a healthy and good habitat for a peaceful life. So it is the duty of your land lord to make all repairs and do whatever necessary to put and keep the apartment in a fit and habitable condition. As your having a baby it is important that precaution must be taken against black mold. So you ask your landlord to take steps to remove black mold and make the apartment in a habitable condition. If your landlord is not taking steps to remove the black mold within a reasonable time then you can make a complaint to HUD /EPA .They will investigate and take appropriate action on your complaint. You can also repudiate the lease agreement,if your complaint has not been cured within a reasonable time. It is also advised that you may consult with an Attorney who is dealing with Landlord -Tenant issues so that you can be prepared before starting a legal battle.

You do normally have to give him a chance to get rid of it/ repair it.

First off not all mold (even black) is dangerous so have it tested. Then yes you must give landlord the chance to resolve issue

It is permitted to break the lease (or sue for the decreased lease value in small claims) if they have failed to comply with the lease and/or there are material health, noise or safety concerns--but save all information, evidence etc. in case they dispute the situation and try to take you to small claims court.
