Default Wayne

Earlier this year I was hit by a car while I was riding my bicycle -- the car driver was at fault. The driver is underinsured and I was taken to my medical insurance provider for treatment (fractured hip).

The insurance company of the driver wants to settle by sending me the max amont of the driver's policy by check BUT my insurance company wants to charge the driver's insurance company for servicing me.

If the driver's insurance compnay writes me a check to settle, does my insurance company have any rights to the amount I received since I already pay them monthly for my medical coverage?

You cannot collect twice but your insurer does not get your setllement otherwise--not quite sure what you mean here.
