Legal Issues Still Cloudy For Medical Pot In San Diego

The County of San Diego stated taking applications today [July 7, 2009] for medical marijuana ID cards. But while the cards may protect patients, the legal issues surrounding the sale of medical marijuana are still cloudy.

"Patients and collectives in San Diego are not safe. It appears our leadership is trying to shut down all collective cultivation in San Diego," Davidovich said.

Collectives are legal under state law, as long as they provide care to medical marijuana patients and operate as nonprofits. Kearny Mesa's Top Quality Collective owner Jordan Jarvis applied for his medical marijuana ID card Monday morning.

"We can now go get ID cards that should be respected by law enforcement on sight without harassment," Jarvis said.

Default San Diego County Approves Medical Marijuana ID Cards



San Diego County Supervisors discuss medical marijuana ID cards after a 3 year delay due to their lawsuit. The County Health and Human Services agency recommends a card program costing $166 per patient per year. Rudy Reyes speaks in favor of the ID cards but against entrusting the County to handle medical records. Wendy Christakes approves of the cards but objects to the price the County is charging. $66 of the fee goes to the state who actually produce the card. $100 goes to the County.

Marijuana prohibition has been a total failure and is perhaps this country's greatest mistake. Not only has it created criminals out of nearly a third of the country's populace, it costs our society billions of dollars every year, creates a strain on our prison system, and has little or no effect on marijuana use in the US. In some cases, prosecuting marijuana use has turned non-violent, middle class kids into violent and unpredictable, career criminals. Once a person has a criminal conviction on their record, they are far less likely to find a good job and become a useful member of society. Other countries with more liberal drug laws have much lower rates of drug addiction among their people. Marijuana should be legal for any adult to use. It should not viewed any differently than tobacco or alcohol. All of these special cards will cost more money when we could be taking the drug dealers money and using it for good; no money no guns The prohibition does not work. Mexico reported record killings and illegal drug profits in excess of $400 million; just think if marijuana was a legal trade, like tobacco: What a difference that would make.
