Hello,
Before I found this site, I had posted my question on Free Advice . com. I did not realize that it was AMERICAN ONLY. the following is what happened. Kicking Up Dust -------------------------------------------------------------------------------- "T_Hip: Hello, A small company with a small parking lot (approx. 10 car parking capacity) routinely has someone blow dirt and dust from their parking lot, using a noisy gas powered leaf blower. This company is located in a residential area, and is surrounded by residential homes. The dust clouds float right into my windows and covers everything in my house. I fix computers and have several PCs open (no walls on the PC chassis), and the components inside of the computers are covered with dust due to the dirt cloud kicked up by the leaf blower. There are absolutely no leafs on the parking lot in question. I'm assuming leaf blowing IS legal and 3 hours of dirt blowing is not. 'Assuming' and 'Knowing' are 2 different things. Is it legal for the company in question to use the dirt blower, and is there anything we (myself and surrounding residents) can do to legally have this dirt blowing stopped. If necessary, we can take time stamped video showing no leaves, a huge cloud of dirt and the time stamp will show the length of time this person is using blower in parking lot. If you cannot advise me, could you please point me towards a FREE Canadian law forum. Thank you ------------------------------------------------ HomeGuru Senior Member: **A: this is a US Law site only. Although US has dust, Canada has more. ----------------------------------------------- T_Hip: That is the stupidest answer I would have ever imagined coming from a law forum. I have found a Canadian Law Forum, thanks for help and also thanks another glaring example of some American smugness, More dust? lol. Within the next decade, America is going to rely on Alberta. Quote: "With their oil, we are gonna' need them more then they need us..." you should step down from your pedestal and watch a 6 minute video: Alberta Oil Sands featured on "60 Minutes" (you can find the video on Youtube) Besides the Oil Sands, Your condescending remark was just plain rude. This is the response I received from worldlawdirect . com You decide which is better. 'No neighbor can make a nuisance or take actions that may harm you. If this is happening repeatedly, write them and tell them they need to stop. If they will not you may say you will file a complaint with the city, you will seek damages in small claims, and you will even consider a criminal law complaint if they purposely keep doing it after be warned. Try to work out something but they have no right to cause damage and irritation to a neighbor. All sorts of prohibitions exist against this.' would it have killed you to say something like that? or is it you have no knowledge of the issue put forth. If that's the case, if you have no knowledge of my concern, why the ridiculous 'Dust' fact? Besides being condescending, alienating the rest of the world from your forums is not a good strategy to promote website growth and or popularity. ---------------------------------------------- VeronicaLodge Senior Member: hahaha you can't even figure out how to post and homeguru and/or americans are stupid? HomeGuru Senior Member: you are simply an idiot that failed to follow posting instructions. The thread here, you purposely left out the fact that you are from Ontario Canada. Information you posted on the other website, along with the fact that you are disabled. ------------------------------------------------ T_Hip: Nice answers, more like excuses and insults. I came back to see if anyone had responded to my issue. What a shock to find that the responses were insulting and non informative. I never once said Americans were stupid, I said that the comment about 'Canada having more dust' was stupid and condescending, not to mention useless. Since you are posting on a 'Legal Forum' , you should really check your facts before you commit to stupidity. I made a mistake by posting on an 'American Only' forum and all you could think of is to make fun of the fact that I posted incorrectly. It reminded me of a 4 year old making a spelling error, then when the teacher points out that error, the snot nosed kid beside him says 'Ha Ha'. If you don't understand what I am implying about you, don't fret neither does a 4 year old snot nosed kid. By being for 'American Issues Only' this site is limiting itself to a small part of the whole planet. You did not address this in your insulting response posts. You didn't address my question about 'not having any knowledge of my issue posted, instead you dished out the excuse 'I withheld posting that i was disabled'. Would that have made a difference? Would you have given me some assistance because I am disabled? If not, then what does my being disabled have to do with anything? No questions were answered by you, only insults. No matter what country you come from, you are ignorant. I know for a fact that your rudeness is not representative of all Americans. ------------------------------------------------- Zigner Senior Member: So, you are comparing yourself to a 4 year old? ------------------------------------------------- Pacer41 Junior Memeber: No mercy for anyone Hey T-Hip, I didn't see your post until today - but that is exactly the route you and your neigbors should take. Direct your concerns in a letter directly with the company. It seems that whoever they are employing to "blow dirt and dust" is making a career for himself at their expense. If there is no satisfaction with that-go the small claims route but I'm betting you won't have to. Good Luck! ------------------------------------------------- Silverplum Senior Member: Needless to say, that was a non-answer. No recpect for you. ----------------------------------------------- Pacer41: Hmmmmmmmmm Why's that?? What did I do? You know, if I've done something wrong - let me know. I am new to this but I thought it was ok once registered, to respond to a post. I'm not claiming to be an expert, but clearly, I felt bad that T_Hip's question was responded to in a manner that reflected poorly on the forum, and on Americans. I was trying to be nice and helpful, I guess. People who aren't familiar with the forums - mostly those that are just checking it out to get a one-time only answer can't expected to be perfect in all aspects of it and may mistakenly post to the wrong one. I don't see how it helps to ridicule them, that's all. I apologize if I over-stepped my boundaries with you all. ------------------------------------------------ Silverplum Senior Member: U.S. Law ONLY. If you think that we are all SO smart as to know not only US Law, but Canadian law also, then thanks for the compliment. If you think that the law doesn't change from one political boundary to the next, you are sadly mistaken Closed" He closed the thread, so he could have the last word, and my membership was canceled for mentioning this site. So feel free to tell other about the poor quality at the other site, which I dont want to mention again. Cheers T_Hip |
