Default OPT and H1 gap

I am currently on OPT and my OPT will be ending in May. My employer is going to file for my H1 but as you know my H1 will start from 1st October 2008. So please give me all the possibilities how I can maintain my legal status in US during OPT and H1 gap.

per the USCIS.gov website, as of this April, you have to file a change of status form to avoid this gap. Here is the link:
