J2 to H1B
My husband was on j1 and his DS-2019 expired on Aug-31-2009 eventually my j2 status also expired on the same day.Till Aug 31, 2009, I was working in non-profit org. on EAD. My husband's status changed to H1B from Sept 01, 2009. I didn't apply for H4 with him. I independently flied H1B and my application was received by USCIS on Aug 27, 09 and approval notice date is Sept 2nd. I have received I-797A notice of action alongwith I-94, valid from Oct 01, 2009. If I count grace period of 30 days, I can legally stay till Sep-30-2009. Am I correct? I believe that doesn't make me "Out-Of-Status". Can I legally stay in USA and resume my work from Oct 01, 2009, or Do I need to go back to India? Please advice.
My old I-94 (when I came to USA) says that it is valid till J1-D/S. |
