Hi all
My situation: I am mechanical engineer, I got laid off due to reduction in force on Nov 21st, I searched for jobs and found one under a consulting group who started my H1 transfer process on dec 22 2008. I got a query from USCIS regarding my W2 around 1 week of Jan and responded back by Jan 28th. I received the LCA case # from the company around feb 15th. I am yet to receive the receipt #. The agreement between the consulting company and me was that I will be assigned project only after I received my Receipt#. Meanwhile I got a very good offer from a another company and they want to apply for my H1B transfer however my pay stubs are from Nov-Dec. What options am I looking at? Consular processing? Rejection of H1 transfer? All smooth because I tried to maintain status however was waiting on USCIS to respond back with receipt #? |

You must go back to your country and work there. If you are from a developing country, then you will be needed there I'm sure.
There are enough unemployed U.S. engineers to fill every engineering vacancy threefold, and your desperation makes it unfair competition to U.S. engineers who don't wish to stoop to the same desperate measures to get sponsorship (such as employment without paycheck). |

I understand that there are enough US engineers, however I would like understand the pertinent options with respect to my H1B, if I wanted socio-economical marketplace advice I would have asked so.
BTW I due to my relentless pursuit to secure a job of my liking and expertise I got a job after 3 months of lay off this involved applying to over 2000 jobs getting 5 hits, 3 interviews and 2 offers. Its the survival of the fittest and not survival of US or non US engineers. My 'job' for 3 months was applying to jobs on websites and job sites for over 8 hours a day. I would like to see a result of my effort and not some rant about ethnicity of workforce. |

Where did the reply refer to anything about "ethnicity of workforce"?
You do know that the U.S. already has the most diverse workforce in the world, (since you brought that up). |

You need to have immigration counsel work with you on the transfer. You technically should have left after the layoff but there can be some exceptions etc.
You might email world law on their home page to discuss privately or consult with a lawyer locally but you should not handle that by yourself at this point. It will depend a lot on your details. I would ignore parts of what else was posted here frankly. |
