Hi All,
I've obtained H1B in last year. Until Jan 16th 2009, I was in Ukraine and didn't do any work for my H1 visa holder, which is body shop middlecompany and they can't get a project for me. I arrived in United States on Jan 16th 2009, and applied for SSN on Jan 30th 2009. I supposed to get SSN in two weeks. In the meantime, I'm staying in my friend's house and looking for a new employer who could make a transfer. Obviously, I don't have any pay stubs from my visa holder. Question: With all that said, can I apply for H1 transfer? What are my chances it will be approved? I really appreciate your help. |

According to the law, you can sue your bodyshop for the entire salary until they officially notify the USCIS that your H-1B visa has been revoked.
It dosn't matter even if they made you sign documents not to be paid while on the bench. They are liable for your entire salary, but you must file within 90 days. |

He is also not ot of STATUS.
Why you guys keep on stressing this man. He is already stressed. Listen man, you are just fine. You have got 101% chance to get your H1B transferred. In fact, you can sue your current employer and he has to pay you your entire salary based on the employment offer letter he gave you at the time of H1B filling. |
