Immigration through investment. EB5 Green Card

My question: Is it legal if someone gives me money as a gift and I invest them (I know the restrictions of EB5 Green Cards) or invest their own money from my name (that I don't own that money directly)? If yes than for how long should the investment be made?

Eligible foreign nationals are investors who have invested, or are actively in the process of investing, the required amount of capital into a new commercial enterprise that they have established.
