Habeas Corpus Restoration Act of 2007

From Wikipedia, the free encyclopedia

This article documents proposed legislation that is currently being considered.
Information may change rapidly as the course of legislation progresses.

A bill, provisionally called the Habeas Corpus Restoration Act of 2007, S. 185, passed the United States Senate Judiciary Committee on Thursday, June 7, 2007.[1]

The bill was sponsored by Democratic Senator Patrick Leahy and Republican Senator Arlen Specter.[1][2] Specter joined the Democrats in supporting the bill, which the Committee passed on a vote of 11 to 8, without debate. The bill would restore the right for Guantanamo captives to access the US court system under the principle of habeas corpus, a right that had been stripped from them by the Military Commissions Act of 2006.[3]

A version of the bill has been introduced in the House of Representatives (H.R. 1416) by Jerrold Nadler (D-NY) and Jane Harman (D-CA).[4]

On June 29, 2007 the Supreme Court agreed to hear outstanding habeas corpus, opening up the possibility that they might overturn some or all of the Military Commissions Act.[5]

The Act was attached, as an amendment, to a Defense bill.[6] Debate began on the bill on September 17, 2007.

S. 185: Habeas Corpus Restoration Act of 2007

A bill to restore habeas corpus for those detained by the United States.

Introduction

From Congresspedia:
The Habeas Corpus Restoration Act of 2007 (S.185): "A bill to restore habeas corpus for those detained by the United States," was introduced on January 4, 2007 in the U.S. Senate by Sen. Arlen Specter (R-Penn.) and committee Chairman Sen. Patrick Leahy (D-V.T.), with 18 cosponsors. On May 22, 2007, hearings were held on the bill by the Senate Judiciary Committee, and on Jun 7, 2007, the committee reported the bill favorably without amendment. On December 5, 2006, Sen. Specter introduced the same bill in the 109th Congress as S.4081. The bill was read twice and referred to the Senate Committee on the Judiciary. Related bills in the U.S. House of Representatives are H.R.267, H.R.1189,...
