V.A. benefits as it relates to a rep payee
my husband and i have been together for 7 years but we have been legally married for 2 years
he has a rep payee for his V.A benefits. he had this for many years. the woman he has she is nice but right now we need help. when we got married we asked if i could become payee it was told to us i could not because we were not married long enough. we have been told many different thins by the V.A but could not get a proper answer. my husband is willing to give me power of atty if that would help. at this time i do all the foot work needed to keep the check going (if i was not around his check would have stopped because there would have been no one to do this) to my understanding the person who is the payee only handles money issues, not the issues concerning when payment to a person who is not entitled to them. if i have to to the foot work why can't i be then. he needs a lawyer now. she states he do not have the funds (she is concerned about having the money to bury him) i'm sorry but some money is being paid out to some one who is not entitled. you can no longer speak directly to any one in the office(tried many times) and we feel that we can not speak to the the payee but need to speak to the V.A please if any one has any knowledge on what steps we can take please advise |

my mom has va benefits and im her next of kin, have been dealing with her disability since i was born and took care of her for the last 10 years ... just received custody of her last week but va doesnt want to make me her payee because thats there rules but they can give her the funds to get drunk everyday when its destroying her...so now that i have custody they want one of there lawyers to control her funds ????? whats wrong with this picture ??? first they would never keep her to get her mentally stable on meds before i had gaurdianship, there excuse was they cant hold her if she doesnt want to be there , but now that i do they want to take control of her benefits ... thats not how veterans should work but the only thing i can suggest is one of the best top ten lawyers in the state against the va ... coming soon will post results

I wish to inform you that you may call the office of Social Security for guidance. They have a 24 hour automated telephone service to get recorded information or you may speak to Customer Service between 7am to 7pm Monday to Friday. You may also make a request for information online.
