An adverse decision, is simply an adverse decision. I fully expect it. All it means is I will file a petition to file suit, pro se, at the federal government's expense which if I prevail they will recover from the state. I cannot be held liable for a judgement against me because it is against the law to attach my constitutionally protected property.

So I can SUE you until there is a judgement WITHOUT PREJUDICE. Had you been paying attention to the LAW and less on the political agendas of those who authorize your evaluations you would be far better off and this would not smack of RICO. Dear ATTORNEY GENERAL, I will petition to name the defendants individually, that the agency will colude to protect those responsible.

HMO of course you will be named conspirator. (Go to bed with a dog and wake up with fleas.)

Unlike where the children of texas settled and you (texas) admit you did not fulfill your obligation by federal law to protect these rights. This is your 3rd STRIKE.

Your First STRIKE, you did it.
Your Second STRIKE, you admit it.
Your Third STRIKE, you continue the same behavior.

While the lawyers in the class action agreed to let you go on the Second Strike. I will not.

HMO you lack the defense "Operating under the Colour" you are not protected. You are liable not only monetarily, but criminally as well. It is illegal for you to mispresent for gain. Look closely I have that one NAILED! So please allow the State of Texas to offer you counsel, they will do as good a job for you as they did for me. Should I send you a picture of the underside of a bus so you will recognize it.

The saga continues, after filing complaints with the HMO unresolved, filing complaints with the Texas Health and Human Services federally charged with protecting my constutionally protected property, being referred back to the HMO or I am referred to the Texas State Board of Pharmacy, or the Dicrimination complaint filed with the US Dept of Health and Human Services remains unanswered presumably referred back to the State remains unackknowledged.

Again, I was solicted for OUT OF POCKET expense for COUMADIN. Folks this is an Industrial Strength Pharamcuetical Quality RAT KILLER, it is a blood thinner. In sufficient dosage it cause the organs in any warm blooded animal to hemorage.

After being tested today, my PROTIME LEVEL WAS 3.7, too high. My doctor decided I needed an adjusted dosage, and called it in to the phramacy. However when I went to pick up the precription I was in formed I must pay to live. As TEXAS ADULT MEDICAID, did not cover the BLISTER PACK the pills were in. Well I think the BLISTER PACK is a good idea because I can closely monitor the POISON the prevents BLOOD CLOTS from hitting my lungs or brain.

Not to mention the HMO (VERY CLOSE TO BEING ANNOUNCED) advertises (POSSIBLY FRAUDULENTLY) they cover ALL PRECRIPTIONS EXCEEDING THE MEDICAID LIMITS.

Today,

I discussed legal action with a DME provider who has not been paid by my Texas Medicaid HMO Molina of Texas.

We discussed me visiting their Attorneys Office to sign for service of a Letter of Demand. I refused to either return the equipment or pay for it. I did agree to sign for the Letter of Demand, since my response is immeadiate the Atty. will be able to file suit against immeadiately and depositions can begin. I agree to be early that day soon. They will proceed will all haste for an early trial date which I have agreed. I DECLARE HERE as to quit or pay. I REFUSE.

TEXAS HEALTH AND HUMAN SERVICES, you will appear in a prompt fashion at the desposition and at the trial. Let it be know I am going to drag you in front of a JUDGE one way or the other.

Yesterday,

Do you complain about dicrimination when it is in your favor? Most people would'nt. But, I am not most people.

After approx. 6 mos. yesterday I picked up my Medicaid glasses from Wal-Mart who is not to my knowledge on the provider list. I didnt have to submit my Medicaid ID. Apparently, Molina Health Care of Texas has not only went out of network, they have gone "Out of Pocket". I suspect they have a lawyer someplace who said, "We have to get this guy off our backs because in court he has "CAUSE". In doing this it creates a unfair practices for the people who are being unjustly denied, or having unreasonable difficulty, or have been defrauded.

I also went for the follow-up on my colonoscopy. The doctor said I might consider opting out for TRADITIONAL MEDICAID. I would but not without it being witnessed by a Judge in a hearing, whatever.
