First off, I am not a lawyer, I am entitlee and complaintant. Please bear this in mind. If I am ever challenged as "practicing" my only shelter will be freedom of speech.
This is beginning to take on a life of its own. I expect I will be able to "discuss" in an intellegent manner. If I dont respond to a particular question it is because either, I do not know, or I cannot at the moment support my opinion in fact. With that said... *Did you ever find any legal help? No as I stated if it comes to this I will represent myself. The reason being is often lawyers are prohibited from being paid, each instance is unique. Often lawyers will load up cases like a Skeet Magazine. Damn, that one got shot down, Damn, that one got shot down, Damn, that one got shot down, WHOPPIE!! that one made it CHA-CHING, HAPPY DANCE! Damn, that one got shot down, oh well. It is my opinion there are few that will explore the actual merits of a case as each is unique. I was self taught to go to a law library, learn where to FIND the law, where to find the ammendments, and where to find the decisions. There is a lot available on the interenet. But to see what its like, go find the US Code establishing the Social Security Act. I warn you, hundreds of hours of reading, in my case eventually requiring glasses. But to this day I can go to a law library pull out the volume with the original code, and every subsequent related volume to present. One weekend evening... I would go mostly on the weekends because the students were partying. I had a professor come up and ask if I was a student. I said No. He looked at the this long table where I had some 20 volumes (federal) opened, along with VERNON state law. He snarled I was hogging the resourses. I explained it was the only way I could keep track. He asked for what? I answered, "a motion to Federal Judge Hippo Garcia". He began at the first volume following the books never touching one. Then he asked, "why didnt you go to law school?" I replied, "I like to eat Shark, and cannibalism is against the law". He frowned, then began laughing as he walked away. *Maybe the attorney general needs to take public comments on this whole situation??? The AG office generally investigates only cases resulting in Prison. Since the State operates Under the Colour and is indemnified, The AG will only persue felonies committed by State Employees. Anything else is considered a civil matter. *Can we all band together as disabled adults in need and sue the state? This is a two part question. First part *Can we all band together as disabled adults in need? Yes we can and a website addressing these issues would be a great resource. Organizing voters. After all, we have heard so much bull, a candidate better not even try. Basically Solidarity and the votes that come with it. Second part *sue the state? It's been done, the settlement I spoke of was the result of a suit like you are proposing. That suit began in 1993, fifteen years ago. Today's conflicts define the successful course. An army advancing on an equal or superior force can expect the following; a stalemate, a defeat not limited to a surrender, a victory only due to tactics. This is a new world and the most effective, are trained and operate independently of a group, placing the maximum pressure on the opposition resourses. A chess game if you will... move and counter move and again until the opponent moves or fails to protect from check, remember there are losses. If your goal is your own gain your opponent has the advantage. Seldom does an opponent rise to the will of sacrifice. Imagine a single defender against a hundred opponents (chess), eventually his inadaqacies<sp> will expose a pattern, a fault. Here is an excerpt from a famous quote: "when a long train of abuses and usurpations, pursuing invariably the same object, evinces a design to reduce [the people] under absolute despotism, it is their right, it is their duty, to throw off such government, and to provide new guards for their future security." google this for a surprise, the whole thing excluding the qoute marks. Here's where folks are going to get mad. I lost my job... when my doctor ordered 2 weeks bed rest. I returned to work and could not preform and returned to the doctor. After several months I applied for work at the state operated employment agency. I explained I didnt have money to pay the mounting health care costs, including a hospital stay, and had no choice but to seek employment. I was told no employer would touch me, and was refered to the Texas Rehabilitative Services. They required I file for SSI, 90 days later I was awarded. I went to the consuelor<sp> and noted, never had I heard of such a thing and was wondering if "they" knew something I didnt, like I wasnt going to live long enough to spend the first check, so give it to me! Please understand, I have already thrown myself under the bus, so I would consider it bad judgement to hold my hand. I filed my complaint and told everyone, go see it on the internet. WLD no doubt has scores of hits from tx.us and other state servers. They all know my name, my address, my total life history. So, you may want to gleen any of your personal info. I guess I should be glad it was an enima and not a blood transfusion... I thought I read, 3 days. If so another fault. I will have to go back and look. I rememember an old radio ad. AND THE HITS KEEP ON COMING!!! |

Its been a week,
Thanks to WORLD LAW DIRECT, this post has rocketed through the search engines and an impressive 300 unique views. I am reviewing HR 6331 Since, it appears Texas is also applying for exemptions so they can go to insurance voucher look alike. Maybe it is to our advantage to challenge HR 6331. HR 6331 on the face appears to be for the benefit of the entitled. But what good is it if Texas is allowed to apply for exemptions to circumvent it. |

I think the Govenor should take input. I wonder if he could "stand in" for the water hose!
The HMO called a little while ago... I deliberately have not mention them by name. As my complaint was filed with the State, I wonder how it made it's way back to the HMO when I am waiting for a response from the state and my option to request an administrative hearing after the ombudsman. ... to be continued, there's more. I filed a formal complaint with the State THHS department. As far as I am concerned it was a whistle blower complaint. I dont care if it involved them or not. To forward my complaint to the HMO was tet amount to colusion. Send me back through the revovling doors.
Justice delayed is justice denied. The State answered a fifteen year long lawsuit by settling, which they confess by action they intended to thrawt the constitionally protected rights of it's citizens. They did not plead it was a mistake, or they were stupid, they settled. So if the Law and right were on their side, why didnt they dodge this another fifteen years. On the other hand why didnt they settle a year into the suit. What happened fourteen years later that they were compelled to settle. They ran out of rope. And NO CONTESTE is not a plea afforded the DEFENDANT when the DEFENDANT is the State, unless it was their first pleading. I contend that they did not reform, in fact UNDER THE COLOUR continue the same behavior. The thing about a settlement, it vaporizes a complaint. My guess is it was headed to Federal Court, the end of the rope. But they forgot history is a judge as well. To the HMO: The reason you could not contact me is I gave you the land line I connect my computer to. My reason is, as you announce you record and under Texas law I DO TOO! UNANNOUNCED! If you can understand anything through those thick Pakistani, accents, COME ON THE GUY'S REAL NAME IS NOT BOB! Oh yes, my file where the advocate was commanding to speak to a Supervisior when I was referred to a doctor not even in the field of specialty. So, my next DEMAND will be that transcript. You had better show it because I am going to make the State show it. I am just hoping they say they destroyed it. I will rip them from anus to adam's apple. Its so cute you found my cell #, lemme guess how you got it. If I want to iniate a conversation with you I will, If I don't I won't, so much for privacy which I signed away anyway. Now, as to your solution "Nulytely" you had better pray I am not allergic! Plus there is something I know you don't. How ever should you fail to provide a solution, I promise you will be NAMED and your provider list will be published here. Every Doctor that says NO, BUT HELL NO! To THHS: I will petition for a hearing. To my State Rep.: I wonder which counties are more poorly represented than yours. And besides I elected you my advocate I now DEMAND it. Not word one. To my Congressman: You fail, You fail. Sixth grade girls: Please respect your body as the Lord claims it a temple. If you do not respect it no one else will, because you don't. If you do, your life will be greatly blessed while others just like you suffer and die. ---------- I am thinking I may need a PAP SMEAR since lately I am so BIATCHY, since I dont need a referral to a SPECIALIST, I am thinking I should check into it. Maybe I should have a mammogram. Or the Govenor maybe RIGHT, and I need a HPV vaccination, even though I am long past the sixth grade, and have had plenty of SEX sometimes more than once a day. I forgot something,
Why are you giving jobs to Pakistanis, when you could be giving them to TEXANS, like the ones in the advocacy department that recently was discontinued. Do you provide Health Care to the Pakistanis? |

Dear HMO,
As you informed me My CONSTITUTIONALLY PROTECTED ENTITLEMENT was charged $216.00 for glasses. As I explained when I was told I could pay out of pocket in addition to my Medicaid and in addition to your $200 valued added member benefit. I instructed VISION SOURCE, Dr. Agnes L. Palys 4930 Evers Road San Antonio Texas, the only provider you stated available in your plan, that I wanted the minimum, I was told the poly carbonate was FREE! All I ordered was bifocal plastic lens and ugly frames. They substituted the POLY-C FREE! Due to these Deceptive Trade Practices, I now refuse to except the product and demand you provide me another provider within 10 days. Exactly how many counties does he/you serve, how many entitlees?
