Default Un-answered Questions Help (eligibility for VAWA)

I was in a abusive relationship for five years and we were suppose to marry but there was police report filed for domestic violence by my mother and he was arrested. I then moved away and he continued to harassed me. I was homeless and was forced or so I thought to give him my 2 daughters. I would see them only every 2 to 3 weeks. I now moved in with someone else and had to kids with this other person. I also went to court and got 50/50 custody of my daughters who were also still being physically and mentally abuse! Can I still qualify for vawa?

For YOU? No. You have long since gotten away from your abuser.

For your children with this person? Only if he is a permanent resident or US Citizen. Read here for more details on eligibility for VAWA to see if your children qualify: USCIS - Battered Spouse, Children & Parents

I wish to inform you that you may not qualify for VAWA as only a battered spouse, child or parent is eligible. You had not married so you may not be eligible.
