Permanent resident seeking to bring fiancee/wife to US asap
Hi
I am a permanent resident residing in the US for the last two years. Recently I started a long distance relationship with an old friend who is residing outside the US. We are currently engaged and plan to get married. I would like to know the best means to get her here permanently fast. I have read about the spouse visa for permanent residents which take 3-5 years or more to process. Are there any other means to get her here more quickly? If she comes to the US on a tourist visa, is there any way to change her status so that we can be together? |

I wish to inform you that you may file Form I-130 and bring your fiancee after marriage to USA. This however takes a long time before a person can come to USA. If your fiancee opts for coming on a tourist visa and then marries you and adjusts her status then this is allowed. In this regard, your spouse will have the burden to show that when she came on tourist visa she was not having intention to marry and decision to marry had been made after arrival in USA. In this regard, tourist visa for marriage is not given but if a genuine tourist comes to USA and then finds someone for marriage then that person is allowed to marry and adjust her status.

Thank you for your reply. Please can you tell me what are the exact procedures and forms to file for a change of status. Do we have to get married before we file for change of status?

Please confirm that the tourist change of status option is also available to spouses of permanent residents, as I am aware that this option is available to a citizen who marries a tourist.
