Minor child is a US Citizen, Mother (Natural) is Alien...

Father (legal resident) is deceased. Mother is living in US illegally with minor child for the last 16 years. Can the alien mother get residency or citizenship before the minor child turns 21. Mother was not married to the father.

I wish to inform you that only a US citizen 21 years or of age older than it can file Form I-130 for a parent. As your son is not a US citizen older than 21 years, therefore, he cannot file Form I-130 on your behalf.

Thank you for your response. I would like to explore the options of the oldest son. Son is 17 years old and has lived in the US since he was 2 years old -- he just graduated from High School. He has been here as an illegal alien. His father was a legal resident but died 10 years ago in a car accident in the US. What are his options for remaining in the US and going to college without returning to his mother country even for a short while.

I found this on the US immigration website that mentions "special categories" of family. This may be something to explore... good luck.
