I am married to a US citizen and came to this country on V1 visa. we had few misunderstanding because of which my wife withdrew my petition before i was able to get the green card. she did this in the year 2003 and my petition was filed in Oct 1998. we survived our marriage for the last 10 years but she did this without my knowledge but she wants to reopen my I-130 so that we both can be togather here in US. so i want to know if she can just send a letter to INS to re-instate my petition or does she have to a file a new petition for me? my current status will be getting expired next month. if she has to file a new petition for me as a citizen how long will it take for my petition to come across? do i have to leave the country? any info on this will be highly appreciated.

if withdrawn you must refile, but try to have counsel see if any exceptions can be made for you under these unsual circumstances
