Malitious False Child Abuse For Custody

My ex-wife has falsely accused me of child abuse on all 4 of my children
(including the 2 who chose to live with me) and sexual abuse of my 3 year
old daughter.
Human services, the sheriffs department and the hospital all looked into
this and reported no abuse. This information was not available at an Order
For Protection hearing.
That judge dismissed the OFP for my son Joseph who is 4 and gave me
supervised visitation with my daughter Jada with my mother being supervising
authority.
He did not want to hear testimony because Motion and Motion had already
been filed and he believed the next Judge would handle it. I pushed for the
release of the findings of the hospital as well as the release of
information from Human Services.
The Judge filed that this evidence be released to both parties. At the
first stage of Motion for custody on 11/08/07 the Judge ruled OFP and
supervised parenting dropped and back into normal parenting time as listed
in divorce decree.
On 01/07/08 the Judge filed that both parties made prima facia showing
and that this would be going to a further custody battle.
Also in this finding he ruled supervising authority ( my mother ) be
present during all parenting time.
This is a punishment to my children, myself, and to my mother, because my
mother is unable to do this.
I had all evidence of no child abuse in court that day but the judge
didn\'t take it that far and let anyone testify.
Now as a result of this decision and the fact that the court date isn't
until June 4th, my children wont get to see me or their 2 older brothers
until after that date.
All of my Ex-wifes allegations are fabricated for malicious reasons. My
ex-wife's new husband is a man who had an unconventional church in the
upstairs of his garage claiming he has died and spent 2 days with Jesus.
He abandoned a wife and 7 kids to be my ex's husband and participate in
this..
1.)What can I do to get the Judges decision changed in the best interest of
my children allowing us to be together for parenting time before June?
2.) I have been denied parenting time for malicious reasons, which my
attorney told me is always overlooked and not enforced. (meaning a felony
law put into effect for a reason but not enforced) Do i have options to push
for prosecution?
3.)What are my rights pertaining to the fact I have been falsely accused of
abuse?
4.)I can not afford private legal aid anymore and my attorney has stepped
down. Is there any options in this area for me? I have been denied legal aid
only because of equity in my home, which is on the market anyways so the ex
can get her share of equity.
5.) Everything my ex-wife is doing is strictly malicious for her cause, may
i sue her for attorney fees?
6.) My 4 year old son Joseph tells my that my ex\'s husband hurts them. He
hits their arms, slaps their hands, pinches them, yells at them and makes
them cry. Is this reason enough for me to file an Order For Protection on
their behalf even though Motion for custody is already set?

You can take evidence of those urgent issues or slapping, abuse etc. and try to get an emergency temp order--regardless of the other motion's schedule.

But you really need to have good solid evidence.
