Married Twice Plus Common Law
Trying to help my brother who is scared to act because of legal issues. He is a recovering drug-attic who is cleaning up the past mistakes he has made in his life. Married in Caifornia in the \'70\'s, separated after 10-12 yrs. On drugs, married another woman in \'89 (switched his middle initial and first name on the license) in Nevada. Separated shortly after that (1994). Moved to South Carolina, moved in with a woman and have lived with her ever since (has 1 daughter, 13yoa). The lady who he currently lives with believes she is a common-law spouse. He wants to wipe the slate clean, he wants to get this all resolved without possible legal ramification. I suggested to him to go ahead and get the legal divorce from the first wife (which she wants - no contest), but the second marraige was not legal and the license has his middle name where his first name should be and his first name is an initial on the license (ex: John T. Doe and Tom J. Doe). Besides, all the info I\'ve read says the second marraige is not legal, does he need a divorce decree for that one also? And the common-law situation, does she have any rightsother than the child? Crazy, I know but he has truely gotten his life back together, drug-free for 9 years.Thanks.
