Default Neglect

I had a domestic incident which occured at my girlfriends house, I do not live there and was a guest in her home. The state is now trying to charge me with neglect for her children which I have no legal responsibility for. Can they do this?

On what basis--

It would seem they felt you put the kids in shock or harm's way, or some such thing?
