Is TN Lawyer pulling fast one on VA girl?
Perhaps my previous posting WAS a bit lengthy.......so I'll just ask this way:
1-Does the state of TN have a law in regards to the amount of money that can be taken out of a childs settlement check for anything else besides Atty. fees?Specifically, funeral expenses.(We live in VA and were told that VA has a law that states the maximum amt that can be taken out for a funeral is $2000.) 2-If there is no law, and money can be taken out for whatever reason the Atty. sees fit, would the child STILL be responsible for funeral costs even if there is a SIGNED document stating someone else will be responsible for the bill(I have a copy of the document-it also stated that they would pay the fees in full within 30 days) 3-After all this, if the child still has to give up money out of their check for funeral costs-would they also have to pay the late fees incurred by the person who signed-since they did NOT pay the bill within 30 days? Document was signed on 12-22-05, so full payment was due 01-22-06. There is a total of about $2000 in late fees!!!!! Please Help! Any answers or advice is welcomed! The WHOLE STORY is on my previous post "$$ from childs settlement check to pay for Dad's funeral???" Its pretty wordy, though! Thanks Again! |

The child's parent or guardian makes the decisions as to costs, and bills etc.
The attorney does not get to decide. And late fees need only be paid if properly agreed to beforehand. |

You do understand--we DO NOT have the check in hand. We were to sign the itemized statement which would mean that we agree with the things on the statement(attys fees,filing,copying fees,FUNERAL COSTS etc)---then the check goes into the trust acct. for 12 business days....then the money is divided appropriately and mailed out. As far as your answer to us being responsible for the late fees incurred- What do you mean by agreed to beforehand? We never knew there were any late fees.........much less, that we'd have to be responsible for the funeral bill at all. Are you an Attorney? |

I am just visiting today but I would suggest you have an attorney look at all the details--and give you an opinion on what is due or not; this seems a bit more complex than a simple forum answer can provide for you.
