Florida divorce settlement isues
My divorce is over after 2 1/2 years, the post divorce issues require liquidation of realestate assets. She dragging her feet on the signing of a sales listing contract for a raw piece of property. My question is: can I sale my interest in the this piece in the form of a 50% insuing a quit claim deed for my iterest in the property? The property is planted pine with income potential just sittng there and I want to make money off of it and she is standing in the way. |

Does your decree give any time limits for the sale? How long ago was the decree signed by the Judge? Since the property is in both names and it is tied up with the divorce decree, you won't be able to sell only your half (unless of course you sell it to your ex). The best thing you can do is to send your ex a certified return reciept letter giving a reasonable amount of time to sign the listing contract. Probably one week would be sufficient since it's only signing the listing contract. Explain to your ex in the letter that if she does not sign within the allotted time frame you will be forced to file a motion for contempt/enforcement to ask the court to order her to sign the listing contract. |
