Default Uncle refuses to vaccate property

My father died recently, my mother, brother and me are living in Shimla (h.P). India. We have a rsidence and a transport godown on my mother's name. My uncle looks after the transport company, which was established by my father and the property is on my mother's name. My uncle refuses to quit the transport claiming that he is looking after the company for 7 years. My father died last year and I am the elder brother but still 19. We want our property back and shut the transport down. Can my uncle be given notices to vaccate the transport or can we simply close the transport one day and tell him that its over?

He can be given such notice if no ownership was given to him either before your father's death or as part of the estate
