Default Can I Have my daughters fathers name put on her birth certificate?

I was divorced in Jan. 2004.
My daughter was born in March 2004.
I was not allowed to put her fathers name on her birth certificate, because I had not been divorced long enough.
I was married to her father in Aug. 2004.
I gave my daughter her fathers last name on her birth certificate.
My divorce papers from Jan. 2004 state ther were 0 children born of this marriage.
I live in NC.
Can I get my husbands name on our daughters birth certificate without involving my ex-husband?
I was told to use general statute 49-12.1.
