Default Age in the state of Texas

At what age can a child tell the court what parent they want to live with? Hopefully soon child does not want to be there and is very unhappy.

I wish to inform you that if the child is of above 12 years of age then the judge will interview the child in chambers. Provisions of Sec. 153.009 of Texas Family Code provide about the age when judge will ask child. Further it also provides that judge may also interview the child below 12 years. There is no obligation on judge to ask child's wishes below 12 years of age but after 12 judge will have to ask.

What Affa posted was pretty much accurate. The child themselves never can actually choose where to live, but the judge will consider their reasoning typically after age 12.
