Default Guardianship... Would I be obligated to pay any type of support payments?

My 16 yr old daughter is currently visiting her half sister and my ex husband to be first wife in Kenosha Wisconsin. We live in Illinois. My daughter wants to stay in Wisconsin and go to school there. She has been in some trouble here in Illinois and the highschool is not great. I let her go visit in Wisconsin to get her away from an abusive no good boyfriend. I was told in order for her to go to school in Wisconsin that I would have to give guardianship to whom she be staying with. Is this true? What would this do to my parental rights? And would I still be able to claim her on my taxes. Would I be obligated to pay any type of support payments?

First, for your daughter to be living elsewhere, whomever she lives with will have to have some type of guardianship of her so they have authority to register her in school, arrange for medical care, act in all ways as a parent would. So you will need to have some type of temporary guardianship papers drawn up to protect her and the people with whom she is living.

As to support, of course you do not expect them to house, feed, clothe her and provide for all her needs. You should compensate them for caring for and housing her.

Whoever provides 51% or more of a child's expenses is entitled to claim for taxes. The IRS has a publication which you should find very helpful.
