Default grandparents rights

I live in WV. My son died last year. He and my former daughter-in-law had divorced due to her becoming a lesbian. They had joint custody of my 8 year old granddaughter. The mother has told me that her companion is going to adopt my granddaughter. I do not support this and it is my understanding that for this to occur the mother would have to relinguish her parental rights. If this happens then why could I not adopt my granddaughter. My sons will stated that if any thing happened to him I should have custody of my granddaughter. (of course he was thinking of having full custody of his daughter) I have nothing against the companion and in fact think she takes very good care of my granddaughter. Can they do this without my concent.

children are not property and cannot be willed to anyone. mom has superior rights over everyone else to have custody of her child. and since YOU are not one of the child's parents, your consent is not needed for your daughter in laws partner to adopt.

I live in wv and my childrens father just died in nov 2007 we was together 13 years not married my the children carry my last name an hes not on there birth certifcate and his brother thats has no children that just went through a divorce is tring to tell me i can not move with my children out of state can you give me some info
