Default Illinois: Is it legal to kick my 17-year-old son out of the house?

I have to kick my 17 year old out of my house. I won't go into the reasons here; suffice it to say they are valid reasons. He can move in with his father, if his father will take him in. I have two questions:

1. Is it legal for me to do this (I'm in Illinois)?

2. I have sole custody. If my son moves in with his dad and gets into trouble, am I still legally responsible for him (even if he's living with his father)?

Yes, your son can move in with his father with your approval. If he's having behavior problems that may be what he needs to straighten him out.

As to being legally responsible for his actions, that will depend upon what he does and when. He's very close to being an adult. What you can do is give the father temporary guardianship to reside with him and the father agree to exercise parental authority and control over him, for whatever period of time you both agree upon.

Perhaps his father can straighten him out.

You can ask your son to move out from the house. 18 is the age of majority in Illinois, but he can emancipate before he is getting the age of majority. It seems that you have to get modify the sole custody order. You can petition to the court and modify the custody order, giving consent to for full custody of the son to his father reserving your visitation rights. If the custody is modified, his father will be answerable for him for the reason that he is having his custody. It is better advised that you may consult with a Family law Attorney who can give a proper guidance in this regard

As a parent with sole custody, the child is your sole responsibility until such time he/she reaches age 18. That is the legal age they become adults.

It doesn't matter what your "valid" reasons are. This is your legal responsibility. Your son is a minor and as such he must live under a legal custodian's roof. He cannot enter into contracts without your permission and he cannot move out of your home unless a family court judge orders it.

If the father does not have any type of legal custody, your son cannot move in with him.

Yes, if your son moves in with his dad and gets in trouble, you will be held liable. You might want to think twice before making such a decision.

So to recap. No, it's not legal for you to do so. And yes, you will be held legally liable should anything happen to your son before he turns 18 if he's not living under your roof.

Why? You did notice the disclaimer at the bottom of each page on this forum didn't you? You do realize actual attorneys do not frequent this portion of the website, do you not?

It's amazing so many people get hung up on whether people who post here bother to register or not. Why? So you won't feel so pathetic about yourselves that you have no life and resort to "registering" on forums where the majority of people who bother to make up screen names have nothing but opinionated diatribes to offer?

Most of the authors I've read on this forum give appallingly incorrect, self serving, opinionated "advice" (you included) that have absolutely nothing to do with the OP'S situations, yet people like you think everyone should register. What exactly did you contribute to this thread besides making an irrelevant (childish) comment? You're proof it's unnecessary to register and you're also proof that people who register do not have anything more substantial to add than unregistered authors.

So far, only pathetic losers post here under user names and all of you have childish opinions but no real legal perspicacity.

Wrong. A parent may make any provisions for residency and guardianship of a child that he sees fit. A parent given custody by the court, similarly make make provisions for where the child resides, private school, with another relative, or non relative if that is his or her choice.
