I have to kick my 17 year old out of my house. I won't go into the reasons here; suffice it to say they are valid reasons. He can move in with his father, if his father will take him in. I have two questions:
1. Is it legal for me to do this (I'm in Illinois)? 2. I have sole custody. If my son moves in with his dad and gets into trouble, am I still legally responsible for him (even if he's living with his father)? |

You can ask your son to move out from the house. 18 is the age of majority in Illinois, but he can emancipate before he is getting the age of majority. It seems that you have to get modify the sole custody order. You can petition to the court and modify the custody order, giving consent to for full custody of the son to his father reserving your visitation rights. If the custody is modified, his father will be answerable for him for the reason that he is having his custody. It is better advised that you may consult with a Family law Attorney who can give a proper guidance in this regard

As a parent with sole custody, the child is your sole responsibility until such time he/she reaches age 18. That is the legal age they become adults.
It doesn't matter what your "valid" reasons are. This is your legal responsibility. Your son is a minor and as such he must live under a legal custodian's roof. He cannot enter into contracts without your permission and he cannot move out of your home unless a family court judge orders it. If the father does not have any type of legal custody, your son cannot move in with him. Yes, if your son moves in with his dad and gets in trouble, you will be held liable. You might want to think twice before making such a decision. So to recap. No, it's not legal for you to do so. And yes, you will be held legally liable should anything happen to your son before he turns 18 if he's not living under your roof. |

ok so ur wrong at 17 16 or any age under it is in fact legal to give temporary guardianship over to another party that party does not have to be family either as long as both parties agree and it is notirized dont question this ive had it done to me 2 times so dont act high and mighty when ur as clueless as the rest
