The man with whom I have lived since 1983 died 2 nights ago in the hospital, where I had gone daily to lend my support. He had a short but serious illness.
I don't want any of his estate, but just to claim his remains and arrange cremation and have his ashes here with me. Because California does not recognize commonlaw marriage, I am being denied. He was estranged from his family, which consists of only his mother and brother (father deceased) who I have tried unsuccessfully so far to locate. I was told by the coroner's office in Sacramento that they will consider my mate "abandoned" after 8 days if no family member claims him or gives written permission for me to claim him. Do I have any recourse? I am heartbroken over this loss but am dismissed because there is no "legal documentation" indicating I may claim him. |

You could try to schedule a family court hearing and have a judge grant you the right to oversee the service etc. Then judge may possibly do so given your history.
