Default Do I have grounds to file a petiton for grandparents visitation?

New Mexico

I have a 7 1/2 month old grandson. I watched him 12 to 14 hours the first three months and the past 4 1/2 months an average of 6 hrs a day.

Dec 23, 2009 my daughter in law was convicted of spousal abuse. Since that day I have seen my grandson a total of four times. Once at a family gathering, once when his great aunt came to see him and two times for less than ten minutes each.

Do I have grounds to file a petiton for grandparents visitation.

You can try but the bio parents by and large control the situation unfortunately.

You could argue that your substantial time with the child requires you not be cut off now--for the child's sake.

I was awarded time but you have to be persistent. I had copied this below a year ago just fyi!! Good luck.


New Mexico

A court may grant visitation rights if the child's parents are divorced, separated, or deceased. Visitation rights may also be granted if the child is over six years old, lived with the grandparent for more than six months, and was subsequently removed from the grandparent's home (if the child is under six, the residence requirement is reduced to three months). Adoption cuts off the rights of grandparents unless adoption is granted to a stepparent, a relative of the child, a caretaker designated in a deceased parent's will, or a person who sponsored the child at a baptism or confirmation.
