Ok Where to start...
Well I left my wife of 13 years for many reasons . There are two children in this relationship . One the eldest is my daughter from an previous relationship the other is our mutual daughter . The eldest is 15 and the youngest 11 . My oldest daughter had originally come with me and was in my care . On a Monday I had sent her off to school as normal and all the problems started then . Apparently my ex-wife retained a lawyer and followed his council . She went down to the family court and filled for a protective order and included My daughter on the order . Mind you the ex-wife has no form of custody to speak of . The Judge issued her the protective order as she asked . Apparently I tried to run her of the road was her reason for the order .
So the order was granted ., The problem here is she legally kidnapped my daughter from me and the courts helped her to do it and the state police refused to file my charges of parental kidnapping , there response was fight it out in court.. By placing Kayla on the protective order Kayla was no longer allowed to stay in my care and I was given the option of sending her into foster care or sending her to live with my ex-wife . So thinking of the best interest of my daughter I sent her to my ex-wife rather then foster care . The ex-wife then filled for custody of my daughter and was granted the temporary custody as there was no where else for her to go as I have no family in the state of NY .
So at this point the courts have barred me from seeing my children on a baseless complaint that i now must appear in court for . They issued a protective order for a child that was in my care and living with me to a person whom has no legal custody of any kind of the child and took her from me . The state essential made her an orphan and then told me I had no choice but to let my ex-wife have her .
So now im fighting for my daughter against for all intents and purposes a stranger . As anyone apparently could have pulled this off by following the same proses .
Im at my wits end does anyone have any suggestions for me.

Ah another man who has been a victim of a vindictive woman using an all too eager to help court system to get her own way.

If you only knew how much this exact scenario takes place every single day in this country, you'd be astounded. That these women, who know darned well they are in not any danger, file these frivolous complaints, and tired and bored judges actually signing them, is a disgrace to all the women across the country who are truly in dire need of one.

This is a typical tactic attorneys advise their clients off, as it it the only way they can get their child back and they know it. The police can do nothing. It's a civil matter.

One would think these judges, seeing so many of these complaints, would get smart and put and end to it, but unfortunately, it continues.

It's odd the judge didn't omit your daughter's name; as a father has a right to see his child regardless of conflict with the mother. It's not the child who's in danger, it's the mother (although this one knows she's not). It should be criminal that a woman can get away with wrecking a person's reputation and putting a black mark on his record, usually for life, for purely selfish reasons.

Get a GOOD attorney and fight this ***** every step of the way. Believe me when I say, if this situation had been reversed in roles, you'd still have come out on the losing end and she still would have gotten her way. Family court is a corrupt joke. Imagine what this poor child has been put through simply because her mother wanted to get her own way.

thank you for the article, just had the same thing happen to me. wife lied and took my 4 year old.
