My husband is well qualified and his case for immigration as skilled worker to Canada is in process since 7th February 2008, his current case is being treated according to old criteria so it is in a long queue. I think he has sound chances of immigrating to Canada if we file a new case for him under new criteria by withdrawing his current case, he is an electronic engg. with more than 10 years of experience in teaching field, university level+6 international publications including 2 in Canada, Vancouver, besides as I am Pr card holder I have also tried to sponsored my husband but case rejected saying that I am inelligible as I am not residing in Canada but my file send to visa office as I have checked the box (in my form \'application to sponsor and undertaking form (IMM 1344 A)\') saying \'to proceed with the application for permanent resident\' .
Kindly advise should I re-apply for his sponsorship with proof that I am now living in Canada or should he file (by withdrawing his previous 7th Feb 2008 case) a new case under new criteria for skilled worker? Please advise which option is faster? |

The re-filing might be easier and faster but you should only make those final decisions with senior immigration counsel advising you. There are many of your personal details and history that could affect your decisions and options here.
