She has a history of violence. Spent time in Juvenile detention for assaulting me and vandalizing the house. Left at 18 to live with a boyfriend. It didn't work out so she begged we take her back...we did and what a mistake.
Defiant, and disrespectful and failing the 12th grade. Will probably not graduate. Believe that 19 years old is considered an adult here in Delaware. She never wants to leave. Will fail high school and then tell the authorities that she wants to repeat the 12th grade (and the school will allow this) and then she said if she is still in school we will still have to keep her in our home. How do we physically get her out. Police called to house and in front of her said we have to continue to support her and we better work it out with her. She now has the upper hand. However, police official in our area said this cop is wrong and she has to leave since it is our home and told us call the police again if she acts up. What if we get another cop that won't have her removed from the home? If we change the locks she will call the police on us. She is making our life miserable. What about family court? Will they just say get Counseling? But we did this already for 2 years and it did not work. Can they issue a court order for her to leave our home within a certain time frame. Do we have any rights at all? She is a guest in our home. Why are we obligated to support her forever? Please help!! |

The police are wrong and they have no business in the matter. It is a civil matter.
If you've allowed her to live there, it's considered her residence. You will have to get an order to evict to get her out. You are not obligated to support her anymore. She's past the age of 18. Contact the school and ask how long they intend to allow her to repeat the 12th grade. I believe there is a limit, due to circumstances such as the one you describe. She appears to be using this as a way to stay in your home and force you to support her. Once she turned 18, however, that stopped. Get an order to evict and get her out of the house. She desperately needs to grow up and stand on her own two feet. |
