Restraining Order Guardian ad litem

Is the Guardian ad litem appointed for a minor in a restraining order case also covered under the court order as a protected person? Specifics that are stated on the Temporary Restraining Order and Notice of Hearing form DV-110 under item #1, (Name of person asking for protection (protected person), it shows the name of the Guardian then, GAL for, and then the name of the minor protected person. Also, the judge who signed the TRO has circled the name of the minor on item #1 with an arrow pointing to the words 'PROTECTED PERSON' and the initials of the judge next to it. On item #3, (List the full names of all family or household members protected by this order the only name listed is the name of the minor (protected person).Another alteration to the terms of the TRO from what was originally requested was that the judge crossed out two items that were apart of the 'Stay-Away Order'. He crossed out the 'JOB' and 'Vehicle' as items that the restrained person has to stay at least 100 yards away from and the judge initialed next to it. During the hearing for the restraining order the judge was asked if the guardian was also protected under the order and the judge said that the guardian was also protected. I don't believe that the Guardian is included as a protected person under the restraining order but for obvious reasons I am not sure. If anyone knows, under the above conditions, whether or not the GAL is also protected I would appreciate it. If not maybe you can direct me to a resource that can tell me. Thank you. |

If the Judge stated, on the record, that the GAL was a protected person, than any conflict between that ruling and the written order will have to be resolved in Court. I would really suggest that you confer with a local California attorney to straighten this out. Go to the WLD main page and contact them. They can provide you with referral information for you area to have legal counsel review the order and give you a formal opinion. AJJ
