Do I have enough backing to get a legal name change?
I would like a name change (deleting the biological father's last name) for my 6 month old. I am not and have not ever been married to the father. I have a protective order for myself and my son as well as temporary custody of my son. He has not paid support even though ordered to do so and he is in contempt of court for not appearing and not following court orders and has an arrest warrant out for him. I don't want anything to do with him and I want to know can I petition the court to make my son's last name my own. His middle name currrently is my last name and I just want to delete the father's name legally. Can I go ahead with my petition?

absolutely,you petition,he wont show up because of warrant. if he doesnt show up,you automatically win your case by default.most times,if you cannot actually serve court papers,you have to run an ad in local paper for 30 days,but im sure your petition will be granted. they have to if he doesnt contest it. if he contests it,click,click,handcuffs and jail,i doubt he will show. hope that helped
