hey everyone, not sure where this is supposed to go as this seems to be a confusing matter for most people i ask i could really do with some help. my partner and i are trying to get his youngest daughter back off his ex, but she seems to be doing a lot of mud slinging in his direction, today we recieved a letter from his solicitor with an attachment saying that the opposite side needed to send a copy of the scott schedule but we don't know what one is, if there is anyone who can help us understand what it is we would be very greatful

a Scott schedule is basically a list of the items in dispute prepared by one party. it is most often used in the settlement of property, landlord and construction disputes. but has spread out into other areas
one party usually the person(s) making the claim prepares the list (or is ordered to prepare the list by a court or tribunal or adjudicator or referee etc) the schedule will have several columns detailing what is claimed for and columns for the costs/estimates and other columns to put in things like references to invoice and bill numbers and then there will be blank columns alongside in which the other party fighting the claim can put their comments and estimates/costs and refer to any estimates they have received or documentation they will produce. WHAT USUALLY HAPPENS IS THAT A Scott schedule is exchanged two three or more times between the disputing parties representatives usually independent experts. Who may or may not refer back to either of the disputing parties. THEN often after about the third exchange of Scott schedules the items agreed (because both parties have compromised to reduce the expense of these exchanges) is reduced greatly LEAVING A SHORTER LIST FOR THE COURT TO DECIDE UPON. |
