Default Quadro

I have been divorced in the state of California since 1996. I have a question concerning my divorce settlement. In the settlement my ex is to receive 50percent of the community interest of my civil service retirement. I am not eligible to retire until 2012, but realize that I have no idea how this is executed. Is it up to my ex to make a claim and if so how does she do it? Also, and this is what I am hoping for, my ex may be willing to give up this claim on my retirement. If she will, how would we go about doing that? She lives in North Carolina and remarried in 1996 after divorce was final. I cannot find an attorney who deals with an issue like this. I was told the word "Quadro" in a phone conversation with an attorney's office which couldnt help me. Please anyone out there who can educate me on this?

Any good family law lawyer should be able to help advise.

You need to review your orders and then see what if anythng you can do.

Normally this all should have been addressed in your final order.

She can give it up--but few would do so...

It's actually "QDRO" for Qualified Domestic Relations Order, but is refered to as a "Quadro" like you said. I work for a financial planning firm, and we are dealing with a QDRO for a client. It is basicly a form given to the distributers of the retirement dollars and they will automaticly distribute the ordered amount to her. Was there a QDRO filed when you were divorced?

thank you for your response. There was not a QDRO filed with my divorce papers, just a simple paragraph stating about the division of the community part of my retirement. I wonder without a QDRO on file how the mechanics of this will work
