I did not call the sub-contrator this time I called Mr. Blackwells home and talked to his wife to get his cell number. He did show up this time. My husband even called from Afghanistan to talk to him. I don't think I have ever been so mad in my entire life! I just couldn't understand why this was happening yet again. Had they done the job right the first time, we wouldn't be going through this again. I asked several times why and what I got was we are going to fix it all! I Promise. He made the same promise to my husband.
I could get into all the horrible details, but I will be here all day. As far as I am concerned his word is worth the dirt I walk on. Everything was fixed but at the expense of the city. CDE had busted the sewer line across the street and that is what was causing our problem. So it was not due to the ocntractor. He could finally wipe the sweat from his brow. But he was very dishonest when it came to collecting money from the city. He charged them for both bathrooms and my bedroom for everything to get replace. The front bathroon had nothing wrong with it except when we did our walk through in Aug of 07 a tile was cracked and never fixed like we asked at closing.
We even sent in a end of year inspection on everything that needed to be fixed before our warrenty was up. I heard nothing back. We have a horrible time with water it has completely damaged our driveway and garage due to the way they designed the rain drainage to our house. In our end of year inspection It was asked that an extentions to out stairs be put in to help with standing water at the egde or the stairs, which was put in, eventually. Our toilet in the master bathroom has never flushed right, it was stated that a new one was to be put in....never happened, and that our dishwasher's pump was going out. Mr Blackwell asked me to call his office and they would take care of it. I did just that, the lady said it is no longer under warranty. I called him back and told him that. He said I'm sorry, but there is nothing I can do for you. I explained to him that It is listed in my end of year warranty inspection that I sent to him before my warranty was up, it is not my fault you took so long to come out here to get things fixed. His repsonse was call me when it goes out!....So you can buy from you who you want to buy from. The choice is up to you. But I do hope that my experiance has opened your eyes on the type of people you could be getting involved with. Lets just say before we can sell this house we will have to get our entire driveway and garage re-surfaced....and lets just face it the house is just over three years old, I really feel that we picked the short straw on our house and it falls on the contractor. We will never buy a new home from a contractor we have not researched. Hope this helps Fran Dearman

I must admit at first you sounded a little picky as there are certain little problems that do arise in new construction, however after viewing pictures you have been taken advantage of.I have worked in the construction field for over 15 years in flooring, concrete, and drywall business.I see how people tell you to get a hold of the contractors ,but in your situation the house was built on a lot either unfit for construction or they built it on site too soon after grading.Either way this is very poor construction all around.It for sure does not have anything to do with subs at all cause no matter what they did the house was going to settle ruining their work.I am also sorry to tell you house in that price range are always like that cause in today's market there is not much room for profit.I have worked for many a builders and I myself would never and I mean NEVER buy a new house in that particular price range cause experience has shown me they are all garbage slammed together as quick as possible using the cheapest building products available in order to be able to make a profit. I guess what I am trying to say is don't buy new you can find a older house for probably cheaper that would be a much better investment.There are some good houses being built these days but they are in the 300 to 400 thousand dollar price range.Weather it costs 140 or 100 thousand they are all pretty much the same house with different upgrades.I hope people read this and realize New is not the way to go unless you are absolutely sure of the builder.Rule number one MAKE SURE LOT IS INSPECTED TO MAKE SURE IT IF FIT FOR CONSTRUCTION AS THESE BUILDERS BUILD ON ANYTHING !

You can go to these different videos and see the house. I've decided to go to every single home built by Chris and Eric Blackwell, and let the homeowners know they're in their loans illegally and their homes illegally and if enough people get on board, something is going to happen. I'm telling them their homes were built illegally and everything. So let Chris, Eric, and their Dad deal with hundreds of folks. Chris and Eric think it's over, it's not over!!! (now WE Blackwell Home which is Eric Blackwell and Chris S Blackwell Construction which is Chris Blackwell). I heard their building in Liberty Park currently. If you go back through the post, you will see I was asking about these guys new licenses and I contacted Ms. Lazenby the Director of the State Licensing Contractors Board and she told me they weren't in business anymore and I said it wasn't true and I gave her their names (new names) and I told her they didn't have licenses listed for them, but to this day she never replied, but all of a sudden Eric now has a license listed for him. Wow! Wander how and when that happened, because they didn't have one and unless he just got it, Chris Business isn't listed with one either, so go and check immediately for it, because the board will give him one real soon, but they know he didn't have one. I didn't check today, so he may have one right now, but he didn't this past weekend. Also Eric's NEW license because he withdrew the first one (I assume because his name is plastered all over the internet like his new name getting plastered by me and others) and if you see this new license states he was licensed in Sep 2009, but how is that when he was still under the other license at that time? Also I picked up my building permit alone with a few other homeowners and they have been manipulated, it's so funny. If a person is going to try and doctor things up they should at least have sense enough to put the right info on it. Anyways judge the videos for yourself.

Thank you for your message. No truly regardless of what anyone thinks, I'm not being picky. The home was 139,900 but valued at 123,000 after the property tax people saw it and that was in 2008 or 2009 and it's worse since then. Yes it's defective work and a structural engineer told me it was foundation, but I knew that before ever getting one to come in. It goes so much deeper than it just being a horribly built house. It is the principal of everything that has happened and the nonchalant attitude the Blackwell's, the city, and the state has about it all, they let them get away with whatever they choose and somebody need to do something about it. I just happened to be the one who won't give up, because I don't feel I should. I've been wronged, so I have a right to do this. Thanks again for your comment and your EXACTLY right, new isn't always better. One thing for sure is it taught me a heck of a lot. Horrible as it has all been and through all of the stress I've endured, I can't call it all bad, because I've definitely learned some things.

Well to update you all, I lost my home although I was in an illegal loan. The home was built by William Eric Blackwell who was Blackwell and Blackwell Construction but is now WE Blackwell Homes in Clarksville, TN and his brother Christohper S. Blackwell who is now Chris S. Blackwell Construction in Clarksville, TN. I contacted many, many lawyers and many didn't even have the decency to contact me back and those who did always claimed to not be able to handle this type of case, too busy, case to complex, etc. This alone is sad. The city of Clarksville gave the Blackwell's hundreds of illegal permits to build hundreds of homes and all of those homeowners are in illegal loans without even knowing it. Although the city and state knows everything they still allow these criminals to continue to build in the city of Clarksville after they've committed millions in crimes. Among the homes built several were in the $200,000's and $400,000's price range. The state of TN law states any contractor (but they couldn't even call themselves that legally because they weren't licensed) who builds anything over $25,000 without a license commits a class c misdemeanor. As I stated many times before the Blackwell's should get felonies behind this because they built hundrends of home illegally and well over $25,000 for each AND they certainly shouldn't be building homes anymore. I found out they built apx 600 homes prior to Eric being licensed in 2008. My home was built in 2006 and they were building unlicensed well before that year.

Also I picked up a copy of my building permit a few months ago and to NO surprise the city had indeed changed some things on it. It appears the city of Clarksville and certain people like the Blackwell's can do whatever they choose to do without any consequences. I will continue to fight this, because I know without a doubt the Blackwell's (to include their father) are guilty of major crimes (fraud, falsifications of documents, unlicensed activity of hundreds of homes, misrepresentation, and the list goes on) x hundreds of people and they should be punished for thier actions.

USAA/PHH are guilty too, because USAA may have not known from the start when they initiated the transaction with Eric and Chris Blackwell, giving them $69,000 illegally because the paperwork has them signed as Blackwell and Blackwell construction (well that business wasn't licensed therefore it too was an illegal operation). Eric and Chris took the name and ran with it just like they've taken millions from all of the loan transactions KNOWING full well they were operating illegally and wasn't authorized to do so.

Once I found out they wasn't licensed as contractors at that time nor as a licensed business, I informed USAA/PHH but they did nothing. I asked to be relieved of the loan many times, they said no. They wouldn't relieve me of the loan EVEN THOUGH they initiated it and gave the Blackwell's $69,000 for it which was fraudulent and illegal.

As I stated in earlier posts USAA dropped my homeowners insurance for no reason whatsoever. They didn't give me an explaination no matter how many times I asked. The only reason I can think was because of my multiple complaints about the home. Then USAA tried to lie and say I had filed a claim against the house, which is a total lie. They dropped my insurance because I kept complaining about the house and asking out of the loan. Then when I couldn't find anyone to carry me they added a bogus insurance of $2024 a mth which went up $200 more to $2224 a yr, when initially it was only $314. That's ridiculous!!! My mortage went up way too much on a defective home which wasn't just built poorly, but has structural damage as well and was depreciated $20,000 by the city of Clarksville. That house can't be patched up due to the structural damage and building it on land that wasn't made ready for a home to be put up on it. It's beyond normal settling, it's crappy construction plus structural issues.

The scheme the Blackwell's set up obviously worked well for them and all of the others involved (the city, the state, real estate co, seller, and title co.) They made fraud against homeowners, public, city, state, and the IRS). They cheated the IRS majorly, because if they weren't licensed as contractors NOR as a licensed business (you have to be a licensed contractor in order to run a business),HOW WERE THEY DOING THEIR IRS, less by fraud? They obviously couldn't do it legally if they weren't licensed. So this is where their father came in, he continued to use his name and his business name to make the illegal monetary transactions so his son's could continue to fraud everyone. Common sense shows it's all fraud, because the state allowed the father William S. Blackwell to continue to stay listed as active license holder knowing full well he wasn't even in the business. I got at least 100 emails plainly talking about it with the board's director, so THEY KNEW. The board's rule is in order to renew your license you must show proof of your financial transactions for the homes built. Well how could Mr. Blackwell (the father) LEGALLY do this? He couldn't, because he wasn't in the business himself AND WHEN HE WAS his business was called Blackwell Construction NOT Blackwell and Blackwell Construction. Eric and Chris specifically had a business comprised of William Eric and Christopher S. Blackwell underneathe their signatures, because it was a part of their signature stamp. Their father was the only person who should of signed any closing documents are was on any monetary transaction documents from whatever banks homeowners went through to do their loans IF HE WAS IN THE BUSINESS, BUT HE WASN'T. The father is the only name that should have been on any transfer of deeds paperwork as well, but during those years you will only see the son's name IT'S BECAUSE THE FATHER WASN'T IN THE BUSINESS, BUT WAS FRAUDING THE PUBLIC ALONG WITH HIS SONS. If you read through this document or the other post you can clearing read it in the minutes with the state ( when the one of the sons along with their father had to stand before the board over this). It was a stragiht joke, because one of the son's and the father stood before the board and blatantly lied saying they didn't know the son's couldn't use his license and what's worst is; the state accepted the ridiculous lie/excuse.

Many are at fault here and many failed me, but I am the one who is continuing to suffer. I lost my home and my credit is messed up which affects everything in a person's life.

I feel as if I am the one who committed the crime, Oh My God! My life is in a mess all because of what the Blackwell's, USAA, and PHH has done to me. I feel as if I committed a crime and is now a felon, that's how bad it is for me, someone who has worked hard for everything in my life. The system has failed me majorly, I really don't know what to do right now. Veterans such as myself and homeowners in general are treated so badly, no one cares that you almost lose your life over what is allowed to happen to them, basically I am living by the grace of God, but it's horrible because my credit is so messed up at this point, everybody and everything goes off of credit. A person can barely live when their credit is jacked up like this. USAA/PHH has reported a lot of mess on my credit concerning when my mortgage went up hundreds of dollars after being dropped by USAA even though I never missed a payment and was paying over $1000 a mth. I don't understand this at all. I'm searching for an out of state attorney. I won't ever give up until the Blackwells and the rest get served justice. The city of Clarksville should be ashamed of what they allow to happen within the city.

Happy New Year! These are SOME of homes and businesses built illegally by the Blackwell's. If people want to do anything about being in illegal loans do what you have to do. I can't say other banks/lenders know, but USAA definitely know of the illegal loans. I'm doing this because no one chose to help me, so if these people want to do anything against the builders do so, because I know some of you (many) have issues with your homes, OUTSIDE of being in illegal loans. At least it will show some of the hundreds of home (including businesses) they built illegally and the many homeowners who are in illegal loans IN THE FIRST PLACE. The city nor state helped me, however I know that they won't have a choice but to do something when a lot of people have something to say. The statue of limitations may have expired, but you can always sue for fraud, false documentation, and many other things. Plus, hopefully they'll be stopped from building ANYTHING! Every home they built was built illegally, they signed illegally all of your closing papers. They stole money from all of the banks, because they weren't who they say they were OR signed as on your loan papers, because their business at the time was legal or licensed...means YOUR LOANS OR ILLEGAL. More to come!! Matter of fact; IF YOU WANT TO SEE IF YOUR HOUSE IS BUILT BY THEM, JUST LOOK AT YOUR LOAN PAPERS (THE DEED FOR SURE). These were all built illegally. They built MANY homes in Arbour Green South including mine. I could add many more starting with the date my home was purchased 07/07/2006, but in reality, you can research it just as I did, so there's a lot more. I believe approximately 600 illegal homes, illegal loans, and illegal permits.
