Exclusive Use of Marital Home-Usage Credits
In California, can the "out-spouse" claim usage credits or Watts credits if they are not paying the mortgage? I secured a source to make the mortgage/second on our home so that we do not lose the marital home prior to selling. The fair market rental value is less than the mortgage. How can he claim usage or Watts credits as he is 1.) not paying any part of the mortgage, 2.) hasn't made any attempt to ready the home for sale and 3.) is stating he should get the credit being the "out-spouse" because now he has to pay rent.
