I need to know my legal rights

First of all, hello everyone, I am new here and really need some help. I am a canadian citizen and have been in a realtionship with an american for nearly 2 years. We had a joint account in Florida as well as north dakota. About 2 weeks ago I wrote a check out of our Florida account and put it into my canadian account which is only in my name. At the time of my writing this check the account address was my address here in canada. The check was written in order to put a down payment on my property so that when he did get across we had a place to live and a new van as we both have kids and I am 5 months pregnant, with his child. Now it gets interesting, about a week ago he got put in jail for child abuse against his son. I got scared because had this happened when he got here I would have lost my kids. Now he is trying to say that I stole his money and they have contacted the bank, a lawyer, the police, and social security. And if I don't send a certified check for 36, 000 they will proceed with legal action. My bank in canada told me that as long as the money has cleared out of our florida account it is mine, anybody know what I can do? Sorry this is so long, please help.

If you can show that you both agreed at the time that could withdraw then you will be fine.

You may still have to co-own the funds or property depending what you agreed.

yes we were planning on getting married but he wanted me to have access so I could pay rent and stuff up here in Canada without him having to send checks and waiting forever for them to clear.
