Default Common Law and Death

I am trying to prove my "common law marriage" to my deceased husband to be able to be the representative of his estate *we had nothing really but it all was destroyed in the fire that killed him* and his mother didn't recognize our "common law" because she is a vindictful ***** *WE ARE ONLY 25, 26 with a 3 yr old child been together for 4 1/2 years but weren't living together at the time of the fire, we were together just waiting to get a better/bigger place before our child and i came back to live together and get our OFFICIAL marriage license*
