Default Separation

My husband and I have ben separated for 4 mos now, he has placed a 2500 retainer fee with a lawyer and I still have received no separation papers could he jump righ tto a divorce on the one year anniversary of separation? If so do I have to give him one right away?
Is he allowed to do this keep me hanging with not knowing his intentions??

There will have to be court proceedings and that will still take some time.
