How long does it take?

I am from Canada and my husband of a 4 year marriage has left in November 2007. We have a 4year old child together. My question is I still have not rec'vd separation papers, he is the one who wants out of the marriage so I would like him to be the one to do the paper work. How long does it take?
He claims he is awaiting one more thing ( pension from reserves???) In the meantime I have my son , I will not allow him to take him without me, being their is no custody arrangement, although I allow him visits once a week from10 am til bedtime. He does not argue this, in fact I found he withdrew as well from his son.

What I am wondering is could he be not filing yet because, he owes me money..I have been a stay at home momfor 4 years he makes a very good income with a pension plan. When does he have to give me part of the equalization after the house sells or part now?? Thank you so much.

It should be done immediately basically; you may want to have a lawyer review the status and check what is really going on.

He is paying the mort, bills, and giving me money per month and still paying my car insurance, this sums up to spousal support and child. But we have been married 4 years so I do not know how long I get spousal for. Is their not a time frame he must file for separation here in canda or will he just jump to divorce??
