Confused my Girlfriend having problems with her F-1 visa

I'm in the Military and my girlfriend is a Physical Therapist and she's from the philippines and planning to take her board here in USA. Her tourist visa is already expired and she is in the process getting a f-1 visa but having problem with the affidavit support, because the person is going to support her wont give her the bank statements needed for the requirements. And its due in April. Can I just marry her instead? I'm a US citizen too, is this legal? thank you

Yes you can do that. And then apply for her change of status. See articles on the WLD site.
