			<content:encoded><![CDATA[<div>chicago illinois, i have a tenant that moved in two months ago she is paying rent with section 8 government assistance. as part of our lease agreement she never switched the gas to her name its been two months i sent her a letter that in 14 days her gas will get shut off by certified mail she didnt accept the letter and it was returned her gas was shut off today its cold out and im not sure if she has kids in there my question is if what i did is legal and should i have handled it in a different manner. she doesnt repond to the gas bill that is owed and section 8 is aware that i am not responsible for paying her gas bill.</div>

			<content:encoded><![CDATA[<div>My apartment was broken into and upon inspecting all the windows to see how the person got in( there was no forced entry, BUT the tenants downstairs have a key to our apartment, given to them by the LANDLORD) we found out that 5 out of 8 windows dont lock correctly, even though we thought they were locked and they were in the 'lock' ed position. Are we able to break the lease because we dont feel safe? or do we have to stick it out for the next 5 months??</div>

Two relatives and I are listed as tenants on a lease...One of the relatives had his income verified by the LL (but no credit check)...My income would not have been sufficient to pay the rent, so my income was not verified...The other relative is unemployed, so her income was not verified...<br />

The relative who DID have his income verified broke his promise to move into the house with me and the unemployed relative...I sent him a small portion of the rent each month (from February-October), but he has been paying the bulk of the rent while living in another state in his apartment (which he was supposed to leave so he could move into the house with us)...He recently became unemployed and has not paid November's rent...<br />
<br />
So, now, the two of us who are living in the house have to go to court for an eviction hearing next month...The relative who lives in another state is also listed on the summons, but I doubt he received a copy of the summons because, on the papers, his address is listed as the house we are being evicted from, even though he lives in an apartment in another state and uses a P.O. box as a mailing address..<br />
<br />
The LL knows that this relative never moved into the house, and he knows that there is no way he would've taken us as tenants based on our lack of income...Yet the LL signed the paper stating that the information on the summons is true, even though the deadbeat relative does not live in the LL's house...The deadbeat's copy of the summons should've been sent to his P.O. Box, or the court should've found out where he lives, am I right?<br />
<br />
My question is, does the LL have to re-file the papers with the correct address for the deadbeat relative?<br />

(Sorry if this sounds very vague and confusing...And for the record, I have never been a deadbeat paying the rent in previous residences, even though I've paid upwards of 75% of my income in order to keep a roof over my head and my unemployed relative's head...It's only when I've become associated with the deadbeat relative that I run into trouble...I left my previous apartment--always paid on time-- because I dared to trust this person, and now I am going to be homeless because my credit and income are insufficient to find another place to live...Forgive me for rambling on...)</div>

I move out of my apartment over a year ago.  I provided a forwarding address on a document that the LL and I both signed.  I never heard from LL again.  There was no security deposit, so I didn't expect to hear anything.<br />

1 year later, I get a text from my former roommate telling me we have been sent to collections for charges exceeding $1,300 which are completely unfounded and fraudulent.  LL was doing a complex-wide carpet replacement (I was witness to this) and is trying to recoup costs from me I believe.  We were two mature adults working full-time.  The unit was left in excellent condition.  Long story short, agency sent me a copy of the &quot;notice&quot; that I never received.  It was sent to my old apartment, not to the forwarding address.  The postal service returned it to the LL.  The LL sat on it for a year.  Had phone number for me, my roommate, my family, and my roommate's family.  Never tried to call us or send the letter to the right address.<br />
<br />
LL failed to send us the itemized charges within the 14 days required by law.  Of course there was no security deposit.  In this situation, what happens?  If the LL didn't follow the law, do they have to drop this?  I have sent a dispute letter requesting a reply by telephone as I live over 2,000 miles away now.  There has been no reply for a week.  Collections stopped calling me (even though I didn't ask them to).  Do I just assume this is over with if I don't hear from them, or should I hire an attorney?<br />

We are both on one lease together.  What i am worried about is she will break &quot;her end&quot; of the lease and I will be stuck with the the entire rent and electric bill for the apartment monthly.  There is no &quot;termination of lease&quot; in our lease itself. Also will I be stuck with large fines for &quot;breaking a lease&quot; when its not of my choice.  I tried to speak with my roommate about subletting but it was too much of a &quot;hassle for her&quot; and she didnt want to have to deal with that.  We are in Virginia if that helps at all.  Any advice or help would be appreciated.</div>
