I work in a pub/club as a barmaid, and recently the owners have employed their son in a similar position. Last week he came into the pub drunk on a night out, and was clearly very drunk. He came behind the bar to get his coat(which he shouldn't have done anyway) and on his way out proceeded to grab my erm... Posterior and give me a cheeky wink. I mentioned this to the bar manager who proceeded to give him his second warning for inapproptriate behaviour (the first was for harassing and even following home a customer).<br />

Once recieved his warning I was happy that was that. However when I went into work next and looked at the rota (which was done by the offending staff members mother) I noticed I only had one shift that week, as opposed to the usual 3/4. I guessed this was petty revenge and was willing to jus let it slide until I recieved a phone calltoday off my manager informing me that matters were getting out of hand and we needed a chat. I've just got back from meeting the two managers, where I have learned the full situation, as outlned below:<br />

1: both the owner and his wife believe that the incident was &quot;an accident&quot; and &quot;didn't happen&quot;, even though it has been witnessed on CCTV by the two managers and assistant manager (and obviously experienced by myself)<br />
<br />
2: this footage has now been deleted from the CCTV records and a password has been applied so neither of the managers can gain access<br />
<br />
3: during phone call between one of the managers and the owner, it was claimed the owners were &quot;trying to get rid of me&quot; due to my filing a complaint against their son<br />
<br />
4: the owners wife has made dispariging remarks about me, along the lines of &quot;I've seen the women my son goes out with, why would he make sexualadvances towards her?&quot;<br />
<br />
Essentially, I'm being pushed out of my job for making a sexual harassment complaint.<br />
<br />
there's probably more, but Im so angry right now my mind isn't quite straight. What's the best course of action? I plan to go to the citizens advice beaureu first thing tomorrow but do you guys have any other ideas? any advice or help would be much appreciated!<br />

Courts in some instances are showing more consideration for employees who feel their employer has violated their privacy electronically. <br />
<br />
“Computers are becoming recognized as being so much a part of the ongoing personal as well as professional life of employees and everyone else that courts are more sympathetic all the time to granting greater recognition to privacy,” said First Amendment guru Floyd Abrams. <br />
<br />
In most instances when using a work device, emails of all kinds are captured on a server and can be retrieved by an employer.<br />

			<content:encoded><![CDATA[<div>Back in 2005 at the age of 19 i was involved in an altercation outside a niteclub in my hometown. I had stepped in to protect a friend from taking a beating from two guys. I had been drinking but not very heavily but still enough to dull my sense of logic. The guards came and subsequently arrested me and one other guy. I had never been in trouble before in my life and told the guards my point of view. The two of us ended up getting charged with public order offences and assault to which we both were convicted. <br />
<br />
Im not a violent person, the opposite in fact. I have thought about those convictions everyday since and have sometimes become so depressed that ive contemplated taking my life. In the last year ive learned to accept these facts but have always wondered how am i going to get a job as garda vetting is compulsory in a hospital-associated occupation. <br />
<br />
Is there a time elapsing period where this record will not matter? <br />
Is it important i mention this to my employer in my application?<br />
Is there anything i can do to remove this record from my life?<br />
What are my rights in the case of an employer not employing me based on this observation?<br />
<br />
Im only out of college and would like to start working but this is keeping me from achieving my goals. There is not a day that goes by that i dont wish i didnt just break up that fight. This has had a profound effect on my life. Im just worried nobody will employ me. If anyone can help me i would be grateful. I work in a profession where the stigma of a criminal conviction doesnt help the way in which you live your life. Im sure there are lots of people out there with the same problem and would hope the responses recieved would help them too. Thank you all.</div>
