My wifes grandmother has been sick for about a year(83). One of the grandmothers kids had a power of attorney and abused it badly. Took all savings, monthly retirement checks, the whole nine yards. And kept her hidden from the family. There are police reports of confrontations with that particular sibling, but the mother would not press charges nor would she let any others. In a moment of lucidity, she signed over her house to one of the other siblings. He paid all bills, kept utilities etc... The grandmother passed away. The sibling that stole all the savings is now trying to sue for the house. Can we demand an accounting of her monies while the sibling had power of attorney. And can we press charges even if the grandmother is deceased?

Yes you can do both of those things.
You will have to have some kind of reasonable grounds if it goes to court. But any reasonable suspicion of misuse, or any evidence of unusual activity will normally suffice. |
