Where to start? Mom's bullying daughter has been leading Mom around for years, and now stands to gain control over the whole estate despite much anecdotal evidence that the girl should not be trusted.
The whole mess was brought to the forefront again upon receipt of a copy of Mom's new Will (timing of delivery made suspect by a health crisis for Mom), which radically differed from the previous Will by giving a bullying daughter control over every aspect of an estate that was widely expected to be split in equal shares between the 2 sisters. This development inspired research into aspects of "undue influence," which are also factors in financial exploitation of the elderly and disabled. Additionally, neither Mom nor bullying daughter denies that, based solely on another daughter's disability, the bullying daughter has coerced Mom into paying her a monthly stipend equal to the amount paid to house the disabled sister. By hook or by crook, if the disabled sister deserved a free house, then so did the ABLED one, who has used the situation to extort a total of $70K+ over the last 10 years - taking advantage of elder AND disabled for personal gain in one fell swoop. Despite being made aware of how thoroughly her chosen Trustee despises her disabled sister, Mom has steadfastly refused to appoint an independent, unbiased Executor. Local police and DHS have rejected it as a civil matter (apparently, no bruising = no abuse?) but, the disabled sister cannot afford an attorney. Of course, being a bully, the ABLED sister can be very convincing but, recent emails contain "excited utterances" which reveal her using tactics such as secrecy, projection, distraction and intimidation toward future beneficiaries. The abuser may be using her position as a local city councilor (and an intimate relationship with a local cop) to manipulate the situation to her advantage. Relatives hesitate to acknowledge the problem outside of very private conversations and friends are unaware because of Mom so strongly "identifying" with her abuser(s) but, Mom's banking records WILL confirm monthly payments if only the cops would look! The disabled sister would likely have become homeless without Mom's help, but the ABLED sister "needs" expensive hobbies: i.e. not one, but FOUR horses which serve as props to her phony "success." We're running out of ideas. It has been suggested to us that we bypass the PD and go straight to the DA and, we're putting together a complaint now. Are there attorneys who would take this thing on a contingency basis? Any questions, please ask! Any other ideas to add to our multi-pronged approach? Help us brainstorm! We need your help.
