I was hired by an IT company last week, worked 3 days and they just sent me an email saying that after doing a background check I had a Class B Felony in Wisconsin! The only arrest or charge I have ever had was a DUI that I received in Florida in 2005, later I moved to Wisconsin, got a WI driver's license, than just moved back to Florida. This was my first Dui, I denied the breathalizer and pleaded guilty. I had a background done on me in September 2006 and the only thing that came up was my DUI. Isn't a Class B Felony a serious crime? How could a first time DUI ever be a Class B? How do I go about finding out more information? Thank you for your help, I am desparate. Also, is it normal for a company to hire you, have you start, and than do a background check? If they decide not to hire me, isn't this discrimination? This job does not require a clean driving record, nor does it have anything to do with driving.

Ask them to provide you with the records; they do have to inform you and show you.

I agree with the above poster. Get the info and if it is not true, inform your employer of the error on your record. Then contact the court or police in WI where the charge came from. It is possible that it is a mistake and it belongs to someone of the same name (but different DOB) or to someone who's SSN is one number off of yours. Remember that info is typed into a computer somewhere by a person and mistakes do happen. Correct it with the WI officials and then have the employer pull it again to show a clean record.
